Discount Tyres Online Ltd Terms and Conditions of Sale

1. Interpretation

In these conditions, 'Discount Tyres' refers to Discount Tyres Online Ltd, the 'Discount Tyres Site' refers to our official website, and 'Conditions' refers to these standard terms and conditions of sale. 'Goods' implies any products (including tyres) which Discount Tyres is to supply in accordance with these Conditions.

2. Basis of the Sale

Discount Tyres shall sell and the Customer shall purchase the Goods in accordance with the Customer's Order and Order Confirmation, subject to these Conditions. These Conditions shall govern the Contract to the exclusion of any other terms and conditions.

3. Offers and Specifications

The Customer's Order shall be deemed accepted only when Discount Tyres issues an Order Confirmation. The Customer is responsible to Discount Tyres for ensuring the accuracy of the terms of any Order. Discount Tyres reserves the right to make any changes in the specification of the Goods which are required to conform with any applicable statutory or EC requirements.

4. Price of the Goods

The price of the Goods shall be the price listed on the Discount Tyres Site at the date of acceptance of the Customer's Order or such other price as may be agreed in writing by Discount Tyres and the Customer.

5. Terms of Payment

Payment for the Goods is due at the time of the Customer's Order. Payment must be made by credit card or debit card through the secure payment gateways provided on the Discount Tyres Site. If payment is not received in full, Discount Tyres reserves the right to cancel the contract or suspend further deliveries.

6. Delivery

Delivery of the Goods shall be made by Discount Tyres delivering the Goods to the location specified in the Order Confirmation. For Fully Fitted Services, delivery occurs upon arrival at the chosen fitting center. Any dates quoted for delivery are approximate only and Discount Tyres shall not be liable for any delay in delivery of the Goods.

7. Risk and Property

Risk of damage to or loss of the Goods shall pass to the Customer at the time of delivery or, if the Customer wrongfully fails to take delivery, the time when Discount Tyres has tendered delivery. Ownership of the Goods shall not pass to the Customer until Discount Tyres has received in cash or cleared funds payment in full of the price of the Goods.

8. Returns

Goods may be returned provided they have not been fitted or used and are in their original condition. The Customer must notify Discount Tyres of their intent to return within 14 days of delivery. Custom-ordered or special-specification Goods may be subject to restricted return policies.

9. Liability

Discount Tyres shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow instructions, or misuse. Total liability shall not exceed the price of the Goods purchased.

10. General

These Conditions and the Contract shall be governed by and construed in accordance with the laws of England and Wales. Both parties agree to submit to the exclusive jurisdiction of the English courts.
